These General Terms and Conditions of Sale are entered into between OH MY CREAM, SAS with capital of €32,219, registered with the Paris Trade and Companies Register under number 751427527, whose registered office is at 47 rue de Babylone, 75007 Paris, and any person who has made a purchase from the http://www.ohmycream.com website, hereinafter referred to as "the Customer". Any purchase from thewww.ohmycream.com website (hereinafter referred to as the "Site") automatically implies acceptance of all of these terms and conditions, which the Customer acknowledges having read prior to placing an order.

Article 1: Buyer's capacity
The Customer who purchases on the Site declares that he/she is legally capable of committing himself/herself under the present terms and conditions of sale.
Article 2: Prices
All prices shown on the Site are inclusive of all taxes. Product prices are indicated in euros. OH MY CREAM reserves the right to modify its prices without notice and the prices applied to the Customer correspond to those displayed on the Site at the time of the order. The goods remain the full property of OH MY CREAM until receipt of the total sum due paid by the Customer.
Article 3: Presentation of items
OH MY CREAM strives to present and describe its products as accurately and precisely as possible.
Article 4: Ordering
The order is validated once the payment has been accepted by OH MY CREAM. OH MY CREAM reserves the right to refuse an order if the Customer already has a dispute with OH MY CREAM or if OH MY CREAM considers that the Customer involves a risk of non-payment. OH MY CREAM reserves the right to request additional information from the Customer, such as identification or proof of address. If the Customer does not reply within 5 days of placing the order, the order and payment will be cancelled. OH MY CREAM undertakes to honour orders received only within the limits of available stocks.
Article 5: Delivery in mainland France
All orders placed before 2pm will be dispatched the same day, except for orders placed on Saturday and Sunday, which will be dispatched the following Monday, and orders placed on public holidays, which will be dispatched the following working day.
The customer can choose between several delivery methods: via Colissimo within 48 working hours, via TNT within 24 working hours, via Mondial Relay within 3 to 5 working days.
Article 6: Delivery outside mainland France
All orders placed before 2pm will be dispatched the same day, except for orders placed on Saturday and Sunday, which will be dispatched the following Monday, and orders placed on public holidays, which will be dispatched the following working day.
Delivery outside mainland France is by IMX or Fedex, depending on the destination. All deliveries to French overseas departments and territories are systematically treated as "international deliveries" according to the postal rates in force on the day the order is placed. For deliveries to the United Kingdom, you can order directly from our English site without customs or import duties. Outside the European Union, customs or import duties may be added to the price of our products and remain the responsibility of the customer. It is therefore the customer's responsibility to check with his local customs office for the amount of these taxes. Shipping costs are at the customer's expense and vary according to destination:

Due to customs regulations, OH MY CREAM does not deliver products to Russia.
Article 7: Payment
A. Payment methods
Once the Customer validates his/her order, he/she accepts the entirety of the General Terms and Conditions of Sale. The customer pays on the www.ohmycream.com website:
- by credit card (CB, Visa or Mastercard) via the Paybox secure payment platform; and/or
- by means of a voucher.
B. 3D secure payment
Your order may be subject to 3D Secure verification. 3D Secure is an authentication-based payment system that guarantees optimum security for your online purchases. During payment, your bank verifies the identity of the cardholder before validating the transaction.
How 3D Secure verification works:
Once you've validated your bank details, you'll be transferred to your bank's website. In the 3D Secure window that appears, the authentication procedure to be followed is specific to each bank. You may be asked to:
- Enter your date of birth
- Enter a code received by SMS
- Or answer a personal question.
This is a secure exchange of information between you and your bank. It guarantees the identity of the card user. If you have any questions about your 3D Secure code (obtaining, loss, modification, etc.), please contact your bank directly. ATTENTION: After 3 failed authentication attempts, your transaction will be cancelled. Your card will be blocked. Please contact your bank.
C. Payment verification
In order to protect itself against certain abusive practices on the part of fraudsters, OH MY CREAM checks the orders that have been validated on its site. As part of this control, our customer service department may ask you to provide certain documents required to validate your order, in particular proof of address in your name, or in the name of the person indicated for the delivery address, etc.
Article 8: Secure payment - Protection of bank transactions
OH MY CREAM entrusts the security of its transactions to Paybox. Payment is secure thanks to our partner Paybox's online payment system. Bank details circulate on the Internet only in encrypted form, i.e. they are encoded in such a way as to make them completely illegible and are therefore never stored by OH MY CREAM.
Article 9: Respect for privacy
All personal data communicated by the Customer on the www.ohmycream.com website are processed by computer for the purpose of processing and delivering orders, selecting samples and suggesting products adapted to the Customer's needs. This data is exclusively reserved for OH MY CREAM.

Article 10: Returns and exchanges
10.1 Purchasing on the www.ohmycream.com website
For all purchases on the www.ohmycream.com website , customers have 14 days from the date of receipt of their order to exercise their right of withdrawal without giving any reason.
In accordance with article L.121-28 of the French Consumer Code, the right of withdrawal may not be exercised for contracts for the supply of goods which have been unsealed by the Customer after delivery and which cannot be returned for reasons of hygiene or health protection (e.g. care products, make-up, etc.). Any goods returned to OH MY CREAM in contravention of Article L.121-28 of the French Consumer Code shall be returned to the Customer at OH MY CREAM's expense without the Customer being entitled to claim any compensation whatsoever.
To exercise the right of withdrawal, the Customer must notify OH MY CREAM (47 rue de Babylone, 75007 Paris - contact@ohmycream.com) of his decision to withdraw before the expiry of the deadline by means of an unambiguous statement (e.g. letter sent by post or e-mail).

In the event of withdrawal by the Customer, OH MY CREAM shall reimburse the Customer for the amount of the order, including delivery costs (with the exception of additional costs arising from the fact that the Customer has chosen, where applicable, a more expensive delivery method than the standard delivery method offered by OH MY CREAM), at the latest fourteen days from the day on which OH MY CREAM is informed of the Customer's decision to withdraw.
OH MY CREAM may defer reimbursement until receipt of the returned products or until the Customer has provided proof of shipment of the products, whichever occurs first.
Where the order was accompanied by a gift offered to the Customer subject to conditions - for example, gift offered only if a minimum order amount was reached - and the Customer no longer fulfils the conditions necessary to obtain the gift due to the exercise of the right of withdrawal by the Customer, the gift must be returned to OH MY CREAM together with the returned products and OH MY CREAM may defer reimbursement until receipt of the gift or until the Customer has provided proof of dispatch of the gift, whichever occurs first.
OH MY CREAM will make the refund using the same means of payment as that used for the initial transaction, unless the Customer expressly agrees to a different means and this refund does not incur any costs for the Customer.
The Customer must return the goods to L4, LOGISTICS POUR OH MY CREAM, ZI de l'Orme Pomponne, 44 rue Paul Langevin, 91130 RIS-ORANGIS no later than fourteen days after the Customer has communicated his decision to cancel. This period is deemed to have been respected if the Customer returns the goods before the fourteen-day period has expired.
The Customer shall bear the direct cost of returning the goods.
OH MY CREAM advises the Customer to choose a mode of transport with tracking number. Without a tracking number, OH MY CREAM will not accept any claims.
The customer is only liable for the depreciation of the good resulting from handling other than that necessary to establish the nature, characteristics and proper functioning of the good.
10.2 In-store purchases OH MY CREAM
Product refunds are not available in OH MY CREAM stores. Thus, when the Customer makes a purchase in an OH MY CREAM boutique, he cannot obtain a refund for the products purchased.
In the store, the customer has a period of fourteen days to make an exchange of equal or greater value than the product originally purchased, or to obtain a credit note in the form of a gift card valid for 1 year.
Article 11: Gift cards
A. Gift cards Amount
Cash gift cards purchased on the Site or in boutiques, can be used for 1 year on all products offered on the Site and in our boutiques, on presentation of the code / QR code received by e-mail (for all gift cards purchased on the Site) or on presentation of the code / QR code present on the paper gift card issued by the boutique (for all gift cards purchased in boutiques). Care gift cards purchased on the French site can only be used in France and Belgium. Care gift cards purchased in the UK can only be used in our London stores.
Value gift cards can be combined with promotional codes (such as the Goodie Bag offer), but cannot be combined with each other. An amount gift card cannot be used to purchase another amount gift card or a cabin care gift card. Gift cards cannot be exchanged or refunded, even partially, for any reason whatsoever (including theft, loss, damage or expiry). The purchase of one or more gift card(s) on the eshop and in boutiques does not entitle the purchaser to our Goodie Bag, even if the basket contains one or more products other than gift card(s).
B. Cabin Care Gift Cards
Cabin Care Gift Cards purchased on the website or in boutiques, can be used for 1 year in our French and Belgian Oh My Cream boutiques. Please note that not all our boutiques offer the same treatments:
- specific Flagships treatments are only available at our Flagships,
- Concept-store treatments can be carried out in any Concept-store.
If you would like to find out more about our range of treatment cabins, please consult our treatment map. In-store delivery is only possible on presentation of the code/QR code received by e-mail (for all gift cards purchased on the website) or on presentation of the code/QR code present on the paper gift card issued by the boutique (for all gift cards purchased in-store). Care gift cards cannot be exchanged or refunded, even partially, for any reason whatsoever (including theft, loss, damage or expiry). The purchase of one or more skincare gift card(s) on the eshop does not entitle the purchaser to our Goodie Bag, even if the basket contains one or more products other than the gift card(s).
Article 12: Promotional codes
Promotional codes apply only to non-rebated base prices and do not apply to limited editions. Promotional codes cannot be combined with each other or with vouchers. Promotional codes can be used 1 time per customer account unless otherwise instructed by OH MY CREAM. These codes are not refundable in the event of an exchange.
Loyalty program
Article 13: Loyalty program
A. Purpose
The "Le Club Oh My Cream" loyalty program is the Oh My Cream loyalty program (hereinafter referred to as the "Loyalty Program"). The Oh My Cream Loyalty Program is a program designed to provide customers with benefits based on purchases made in stores or on the www.ohmycream.com website (hereinafter the "Site").
The Oh My Cream Loyalty Program is dedicated to Oh My Cream customers and gives access to vouchers from a certain amount spent at Oh My Cream. Oh My Cream customers who join the Loyalty Program are hereinafter referred to as "Members" or "You".
Each euro spent (including VAT) on the Site or in an Oh My Cream boutique earns the Member 1 point (hereinafter referred to as a "Point"). However, a payment by gift card is not considered as a euro spent and will not be taken into account as a point.
The Oh My Cream loyalty program is omnichannel, i.e. Points are accumulated for all orders on the Oh My Cream website or in store, provided you are logged in to your customer account on the website or give your email address in store. For more information, please consult the Loyalty Program FAQ.
The above information concerns only our French website and our French and Belgian stores.
B. Eligibility
Only natural persons who are Oh My Cream customers are eligible for the Oh My Cream Loyalty Program. It may not be used by companies or individuals for commercial purposes.
Members undertake to comply with the Oh My Cream General Terms and Conditions of Sale and the present Oh My Cream Loyalty Programme General Terms and Conditions and to behave fairly towards Oh My Cream.
To be part of the Loyalty Program, an Oh My Cream customer must have an Oh My Cream account and be subscribed to our newsletter.
C. How Points work
Every euro spent (incl. VAT) on the site or in the store earns you 1 Point (excluding gift card payments).
Customers can also earn 10 points for each review left on products purchased, subject to validation of their email (within the limit of one review per hour, customers may leave more than one, but will only be rewarded once per hour). Oh My cream reserves the right to delete your review if it corresponds to one of the following cases (and consequently your points will be deducted):
-opinions not related to the use of the product;
-opinion left after using a sample;
-Notice left after using a product not purchased from Oh My Cream;
-defamatory notices;
-notices containing personal data.
If the Customer has entered his/her birthday on the "Le Club Oh My cream" page of his/her Customer Account, 100 points will be credited on that date.
There are different voucher amounts depending on the number of euros spent, corresponding to the amounts below:
- 10€ for 250 points
- 20€ for 500 points
- 40 for 1,000 points
These vouchers can be generated in the "Oh My Cream Club" section of the Customer Account or requested in-store.
From the date your vouchers are created, they are valid for 3 months.
These vouchers can be used for any purchase of €80 or more.
The generation of a voucher is irreversible and cannot be cancelled. Consequently, points cannot be re-credited and the voucher cannot be cancelled.
Points are nominative, personal and reserved for private individuals (Oh My Cream customers) for their own, non-professional use. They may not be transferred, passed on to a third party, exchanged for cash or resold.

Points validity : Points are reset every year, on May 20 at midnight. Points accumulation is rounded down to the nearest euro and takes into account the amount of purchases paid by the Member, net of discounts.
Cancellation of Points: Points relating to a purchase that has been refunded or returned will be cancelled and deducted from the Member's account. In the event of a refund of a purchased item, the corresponding Points will be automatically cancelled. Thus, any Points unduly collected by the Member will be automatically debited from his/her account by Oh My Cream.
D. Personal data
By participating in the Oh My Cream Loyalty Program, customers acknowledge that some of their personal data will be transmitted to Oh My Cream in order to enable them to join this Loyalty Program and benefit from the advantages of the Loyalty Program. As such, all personal data collected, processed and used within the framework of the Oh My Cream Loyalty Program will be used in accordance with the Oh My Cream Privacy Policy of Oh My Cream.
E. All rights reserved to Oh My Cream
Oh My Cream also reserves the right to make personalised offers based on your points. Oh My Cream reserves the right to modify or suspend the Oh My Cream Loyalty Program. The Oh My Cream Loyalty Program may be suspended, modified or terminated in whole or in part without notice. In particular, Oh My Cream may modify its Points scale at any time. No modification, including the cancellation of the Oh My Cream Loyalty Program, shall entitle the Member to compensation.
In the event that the Oh My Cream Loyalty Program is permanently discontinued or completely overhauled, resulting in the loss of valid benefits and/or accumulated Points, Members shall not be entitled to any compensation.
Furthermore, Oh My Cream cannot guarantee that the benefits and/or Points accumulated but not used will be reused in any form whatsoever as part of a future development of the Program.
Oh My Cream reserves the right not to contact Members who are not active in the Loyalty Program (i.e. those who have not made a purchase for more than 12 months) to inform them of any changes to the program or of the loss of their Points.
No modification, change or deletion of the Loyalty Program will entitle the Member to compensation.
The Member is not entitled to any compensation, in particular in the following cases:
-
in the event of fraud, attempted fraud or theft by the Member in the store and/or on the Oh My Cream website,
-
inappropriate use or misuse of the Oh My Cream Loyalty Program,
-
an abnormally high number of transactions on a single purchasing day and/or over several days,
-
in the event of a payment incident not remedied within one month of a reminder from Oh My Cream, and more generally, in the event of failure to comply with the provisions of Oh My Cream's general terms and conditions of sale and these general terms and conditions of the Loyalty Program.
F. Oh My Cream responsibilities
Oh My Cream accepts no liability whatsoever for the direct or indirect consequences of any anomalies or malfunctions in the Loyalty Program, regardless of their cause. Oh My Cream will nevertheless use its best endeavours to ensure that the Member retains the benefit of his/her accumulated Points. Oh My Cream shall not be held liable in particular if the non-performance or improper performance of its obligations is attributable to the Member, or to a case of force majeure.
G. Partial disability - Modification of general terms and conditions
Oh My Cream reserves the right to modify the present terms and conditions and will inform the Member of any modification by the means it deems most appropriate (emailing, updating of the new terms and conditions on the ohmycream.com website).
If any provision of these terms and conditions is held to be unlawful or invalid, such invalidity shall not affect the validity of the remaining provisions of these terms and conditions. Oh My Cream reserves the right to adapt or modify these terms and conditions at any time and without prior notice, such adaptations or modifications to be applicable to any use of the Loyalty Program subsequent to such adaptations or modifications.
H . Disputes - Applicable law - Jurisdiction
These terms and conditions are governed by French law. Only the French version of these Loyalty Program terms and conditions of use is binding. Any dispute arising from the interpretation or execution of these terms and conditions and its consequences shall be brought before the competent French courts.

Article 14: Intellectual property
All visual, textual and audio elements on the www.ohmycream.com website are the exclusive property of OH MY CREAM or the holder of the relevant intellectual property rights, and are therefore protected by the French Intellectual Property Code and copyright. As such, any reproduction of the OH MY CREAM brand or the www.ohmycream.com website, in whole or in part, is strictly prohibited.
You may establish links to our Website provided that you do so in a fair manner and that this does not in any way damage our reputation or take advantage of our good name. You may not, however, establish such a link in such a way as to suggest any form of association where none exists. Furthermore, it is strictly forbidden to set up a link to our Site on a website that does not belong to you. We reserve the right to remove links without notice.
Article 15: Limitation of liability
OH MY CREAM shall not be liable to third parties for any indirect damage, special damage or incident resulting from the Customer's negligence, failure or clumsiness, or resulting from the Customer's misuse of any of the products offered for sale on the www.ohmycream.com website. Regarding access to the Site, consultation of the Site, the ordering process, payment, delivery and service, OH MY CREAM has only an obligation of means. OH MY CREAM shall not be held liable for any inconvenience or damage inherent in the Internet network, in particular any disruption of the connection or any intrusion of a computer virus. Furthermore, OH MY CREAM shall not be held liable for any event qualified as force majeure as defined by the jurisprudence of the French Supreme Court (Cour de Cassation). Finally, OH MY CREAM's liability is limited to the amount of the Customer's order.
Article 16: Legal warranty
Products sold on the www.ohmycream.com website are subject to the legal guarantee of conformity set out in Articles L.217-4 et seq. of the French Consumer Code and the guarantee against hidden defects set out in Articles 1641 et seq. of the French Civil Code.
16.1 Legal warranty of conformity
Article L. 217-4 of the French Consumer Code: The seller delivers goods in conformity with the contract and is responsible for any defects in conformity existing at the time of delivery. He is also liable for any lack of conformity resulting from the packaging, assembly instructions or installation when the latter was made his responsibility by the contract or was carried out under his responsibility. Article L. 217-5 of the French Consumer Code: Goods conform to the contract: 1° If they are fit for the purpose usually expected of similar goods and, where applicable : - if it corresponds to the description given by the seller and possesses the qualities that the seller has presented to the buyer in the form of a sample or model; - if it has the qualities that a buyer may legitimately expect in view of the public statements made by the seller, by the producer or by his representative, particularly in advertising or labelling; 2° Or if it has the characteristics defined by mutual agreement between the parties or is suitable for any special use sought by the buyer, brought to the seller's attention and accepted by the latter. Article L. 217-12 of the French Consumer Code: Any action resulting from a lack of conformity must be brought within two years of delivery of the goods.
16.2 Warranty for defects in the goods sold
Article 1641 of the French Civil Code: The seller is liable for any hidden defects in the item sold which render it unfit for its intended use, or which impair this use to such an extent that the buyer would not have purchased it, or would have paid a lower price for it, had he been aware of them. Article 1648 of the French Civil Code: The action resulting from redhibitory defects must be brought by the purchaser within two years of discovery of the defect.
When acting under the legal warranty of conformity, the Customer :
- has a period of two years from the date of delivery of the goods in which to take action;
- may choose between repair or replacement of the good, subject to the cost conditions stipulated in article L.217-9 of the French Consumer Code;
- is exempted from having to prove the existence of the lack of conformity of the good during the twenty-four months following delivery of the good.
The legal warranty of conformity applies independently of any commercial warranty.
The customer may decide to invoke the warranty against hidden defects in the item sold, as defined in article 1641 of the French Civil Code, and may in this case choose between rescission of the sale or a reduction in the sale price, in accordance with article 1644 of the French Civil Code.
Article 17: Disputes - Complaints - Information

In accordance with the provisions of the Consumer Code concerning the amicable settlement of disputes, Oh My Cream! adheres to the e-commerce mediator service of the Société de la Médiation Professionnelle (smp) whose contact details are as follows: Médiateur-Consommation-smp - 24, rue Albert de Mun - 33000 Bordeaux- https://www.mediateur-consommation-smp.fr/. After consumers have made a prior written request to Oh My Cream! and in the event of a complaint not resolved amicably by Oh My Cream! customer service, the ombudsman service may be contacted for any consumer dispute which has not been settled.

Article 18: Applicable law
The Customer accepts and fully acknowledges that French law governs these General Terms and Conditions of Sale, as well as any dispute or litigation that may arise between the Customer and OH MY CREAM. Furthermore, the Internet user (or Customer) accepts that in the event of a dispute following a visit to or purchase from www.ohmycream.com, the French courts shall have jurisdiction.
Article 19: Modification of the GCU/CGV
OH MY CREAM reserves the right to modify and update the GTC/GTC without prior notice. OH MY CREAM will publish the new GTC/VGC on its website. In order to be informed of these possible modifications, OH MY CREAM advises the Customer to reread the GTC/GTC of the Site regularly. The Customer's order shall be subject to the GCU/GCV in force at the time of the order.
Personal data protection statement
1. General data collection and use
a. Ordering: When you place an order with us, we record your personal details in order to process your order as efficiently as possible and to dispatch the products you have purchased. This information is also stored for security purposes, to comply with legal and regulatory obligations, and to enable us to improve and personalize our offers. Your e-mail address enables us to send you an order confirmation and to communicate with you if necessary. Your e-mail address is also used to identify you when you log in to your user account. The personal data collected on www.ohmycream.com are exclusively reserved for OH MY CREAM.
b.Logging in to your user account: When you place an order on our site, we offer you access to your password-protected "User Account". This allows you to access information about your past orders and to correct your personal information if necessary. It is important not to divulge to third parties the access data to your "User Account", whose use is strictly personal.
c.Advertising: We use your data to send you information about our products and to recommend products for sale on our site that may be of interest to you. We use e-mail advertising only to the extent permitted by law.
d.Newsletter subscription: If you decide to subscribe to our newsletter, you will receive information about special offers which you can stop receiving at any time by clicking on the link provided in each newsletter. The information collected when you subscribe to our newsletter enables us to provide you with more relevant commercial offers.
e. Website consultation: For security reasons, the following data may be collected and temporarily recorded when you visit our site: domain name or IP address, http response code, number of bytes transferred, address of the website from which the user arrived. This data is collected completely anonymously (we collect the data but do not associate it with an identity) and enables us to provide more relevant offers to our users.
2. Data storage using cookies
A cookie is a small file stored on your computer. It contains information about browsing on our site's pages. It is used to facilitate subsequent use of the site by the same person, and to remember the preferences chosen by a user during a visit. You can restrict the use of cookies by configuring your browser, although this will limit the use of certain services we offer on our site. You can also delete cookies manually.
