ARTICLE 1 - ORGANIZER
The www.ohmycream.com website is published and produced by Oh My Cream, a simplified joint stock company with capital of 22,910 euros, registered with the Paris Trade and Companies Register under number 751 427 527, with registered offices at 129 rue de l'Université, 75007 Paris, France. Oh My Cream's VAT number is FR71751427527. The publication director is Mrs Juliette Lévy. Oh My Cream organizes under the conditions defined below, a free game without obligation to purchase entitled " Rouje x Oh My Cream (2021)" from Tuesday, November 2 , 2021 (07:00) to Monday, November 8, 2021 (23:59), as part of the promotion of its products.
ARTICLE 2 - CONDITIONS OF ACCESS TO THE GAME
The game is open to anyone over the age of majority residing in France (including Corsica and French overseas departments and territories), excluding members of the organizing company's staff and members of their families in the direct line (ascendants, descendants) or collateral line, their spouse, cohabitee or civil union partner.
Failure to comply with the conditions of participation set out in the rules will invalidate participation.
The organizing company reserves the right to carry out any checks it deems necessary, in particular concerning the identity, age and address of each participant, in order to ensure compliance with the stipulations of the present rules.
ARTICLE 3 - PRIZES
The (10) winners will be awarded each of the following prizes:
- 1 60min Dermalogica treatment at the Oh My Cream flagship at 78 rue Montmartre - Paris 2ème (worth €80)
- 1 Rouje gift voucher worth €250 to spend in the Rouje boutique - 11 bis Rue Bachaumont, 75002 Paris
ARTICLE 4 - TERMS OF PARTICIPATION
To participate, all you need to do is :
- Log on to the ohmycream.com website;
- Go to https://www.ohmycream.com/pages/rouje-x-oh-my-cream-concours
- Fill in the entry form with all the required information, and click on "Enter".
Answers sent by any other means (private message, email...) will not be accepted. Only one entry per person will be accepted.
ARTICLE 5 - PRIZE ALLOCATION
The organizing company will proceed with a draw among the participants who have completed the form in order to designate ten (10) winners.
The names of the winners will be indicated on November 9, 2021, by sending an email to the winners, who will be invited to communicate their contact details (surname, first name and postal address), within seven (7) days, by email to the organizing company. If the winner does not come forward at the end of this period, he/she will be considered to have renounced his/her prize.
The organizer undertakes to send the prizes by ordinary mail, within six (6) weeks of the transmission of the winner's details (as evidenced by the postmark).
Prizes that cannot be delivered for reasons beyond the control of the organizing company (incorrect address, no response from the winner, etc.) will be definitively lost and may not be reallocated.
The winners may not claim the cash equivalent of the prize won or ask for it to be exchanged for other goods or services, for any reason whatsoever. The prizes may not be passed on to third parties.
In the event of force majeure or if circumstances so require, the organizing company reserves the right to replace the prizes won with other prizes of equivalent nature and value, without this giving rise to any compensation or indemnity of any kind.
The organizer cannot be held responsible in the event of delay or loss and/or damage to the prize in transit.
ARTICLE 6 - DISPUTES AND LIABILITY
Participation in the game implies unreserved acceptance of the rules in their entirety. Any inaccurate or misleading declaration or fraud will result in the participant's disqualification.
No telephone or written request concerning the interpretation or application of these rules, the mechanisms or terms of the game or the list of winners will be answered.
The organizing company reserves the right to take legal action by any means against any attempt to misuse the present rules, particularly in the event of the communication of erroneous information.
The organizing company cannot be held liable for any incidents that may arise from the use of the prizes awarded.
Oh My Cream shall not be held liable in the event of a malfunction of the Internet network preventing access to the game or its proper conduct.
In all other cases, in the event of a dispute or claim, requests must be sent to Oh My Cream within a maximum of fifteen (15) days after the close of the game (as evidenced by the postmark), by simple letter addressed to "Customer Service". This letter must indicate the precise date of participation in the game, the participant's full contact details and the exact reason for the dispute. No other means of dispute or claim may be taken into account. The organizer's decisions are final: Oh My Cream is the sole arbiter of all questions relating to the application of the rules.
The game and the interpretation of these rules are subject to French law.
ARTICLE 7 - REIMBURSEMENT OF EXPENSES
For participants who use an Internet connection that is billed by the duration of the connection, the Internet connection for participation in the game will be reimbursed upon written request to the address of the organizing company, with proof and on a flat-rate basis of €0.16 per minute, including tax.
Given the current state of service and technology, some Internet service providers offer a free or flat-rate connection to Internet users. Under these conditions, participants are informed that any access to the game carried out on a free or flat-rate basis (such as in particular connection by cable, ADSL, etc.) will not give rise to any reimbursement, on the grounds that the subscription to the services of the access provider is contracted by the Internet user for his overall use of the Internet and that the fact that participants connect to the Facebook social network and take part in the game does not cause them to incur any additional costs.
Postage costs incurred for the reimbursement request will be reimbursed on the basis of a stamp at the current slow rate (less than 20g) on the date of this game.
To obtain reimbursement of their connection costs and the cost of postage for their reimbursement request, participants must send the organizing company, within one month of the disbursement of these costs (as evidenced by the postmark), a written request, drawn up on plain paper, containing the following information:
- surname, first name and personal postal address, together with official proof of identity and a bank statement.
- name of the game and the website where the game is accessible
- supporting invoice with dates, times and duration of connection clearly underlined
The organizing company will reimburse said expenses by bank transfer within two (2) months of receiving the participant's request.
ARTICLE 8 - PERSONAL DATA
In accordance with the French Data Protection Act no. 78-17 of January 6, 1978, and European Directive no. 95/46 of October 24, 1995 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, winners' contact details may be processed on paper or by automated means. In accordance with articles 38 et seq. of the aforementioned law, the winners have the right to access, rectify and delete their personal data by sending a written request to the game address.
Persons who exercise their right to delete their personal data before the end of the operation will be deemed to have waived their right to participate.
The organizing company and its partner Rouje are the sole recipients of the information collected, which will not be used for commercial prospecting purposes or passed on to other commercial partners without the prior consent of the participants.
