ARTICLE 1 - ORGANIZER
The website www.ohmycream.com is published and produced by Oh My Cream, a simplified joint stock company with a capital of 22,910 euros, registered in the Paris Trade and Companies Register under number 751 427 527, whose registered office is located at 129 rue de l'Université, 75007 Paris, France. Oh My Cream's intra-community VAT number is FR71751427527. The director of the publication is Mrs Juliette Lévy. Oh My Cream is organizing, under the conditions defined below, a free game with no obligation to purchase entitled " Rouje x Oh My Cream (2021)" from Tuesday, November 2, 2021 (7:00 a.m.) to Monday, November 8, 2021 (11:59 p.m.), as part of the promotion of its products.
ARTICLE 2 - CONDITIONS OF ACCESS TO THE GAME
The game is open to all natural persons of legal age residing in France (including Corsica and French overseas departments and territories), excluding members of the organizing company's staff and members of their family in a direct line (ascendants, descendants) or collateral line, their spouse, cohabitant or civil union partner.
Failure to comply with the conditions of participation set out in the rules will result in the invalidity of the participation.
The organizing company reserves the right to proceed with any verification it deems useful, particularly concerning the identity, age and address of each participant, in order to ensure compliance with the stipulations of these rules.
ARTICLE 3 - ENDOWMENTS
The (10) winners will be awarded each of the following prizes:
- 1 Dermalogica 60min treatment to be used in the Oh My Cream flagship at 78 rue Montmartre - Paris 2nd (worth 80€)
- 1 Rouje voucher of 250€ to spend in the Rouje store - 11 bis Rue Bachaumont, 75002 Paris
ARTICLE 4 - TERMS OF PARTICIPATION
To participate, each participant must simply:
- To connect to the ohmycream.com website;
- Go to the web page https://www.ohmycream.com/pages/rouje-x-oh-my-cream-concours
- Complete the entry form with all the required information, and click on "I participate".
No answer sent by any other means (private message, email...) will be accepted. Only one entry per person will be considered.
ARTICLE 5 - ALLOCATION OF PRIZES
The organizing company will proceed to a draw among the participants who have completed the form in order to designate ten (10) winners.
The names of the winners will be indicated on November 9, 2021, by sending an email to the winners, who will be invited to communicate their contact information (last name, first name and mailing address), within seven (7) days, by email to the organizing company. If the winner does not come forward at the end of this period, he/she will be considered to have renounced his/her prize.
The organizer undertakes to send the prizes by simple mail, within six (6) weeks following the transmission of the winner's contact information (the postmark being proof).
The prizes that could not be delivered for reasons beyond the control of the organizing company (wrong address, no response from the winner ...), will be permanently lost and can not be reallocated.
Winners may not claim the cash equivalent of the prize won or request its exchange for other goods or services, for any reason whatsoever. The prizes may not be passed on to third parties.
In the event of force majeure or if circumstances so require, the organizing company reserves the right to replace the prizes won by other prizes of equivalent nature and value, without this giving rise to any compensation or indemnity of any kind.
The organizer cannot be held responsible for any delay or loss and/or damage to the prize during its delivery.
ARTICLE 6 - DISPUTES AND LIABILITY
Participation in the game implies unreserved acceptance of the rules in their entirety. Any inaccurate or misleading statement, any fraud will result in the disqualification of the participant.
No telephone or written inquiries regarding the interpretation or application of these rules, the mechanics or terms of the game, or the list of winners will be answered.
The organizing company of the game reserves the right to pursue by any means, any attempt to misuse these rules and especially in case of communication of false information.
The organising company cannot be held liable for any incidents that may occur as a result of the use of the prizes awarded.
Oh My Cream shall not be liable for any malfunction of the Internet network preventing access to the Game or its proper conduct.
In all other cases, in the event of a dispute or claim, requests must be sent to Oh My Cream within a maximum of fifteen (15) days after the close of the game (as evidenced by the postmark), by simple letter addressed to "Customer Service". This letter must indicate the precise date of participation in the game, the participant's full contact details and the exact reason for the dispute. No other method of dispute or claim can be taken into account. The decisions of the organizer are final: Oh My Cream is the sole arbiter of all questions concerning the application of the rules.
The game and the interpretation of these rules are subject to French law.
ARTICLE 7 - REIMBURSEMENT OF EXPENSES
For participants who use an Internet connection that is billed by the duration of the connection, the Internet connection for participation in the game will be reimbursed upon written request to the address of the organizing company, with proof and on a flat rate basis of € 0.16 per minute.
Due to the current state of service and technology, some Internet service providers offer a free or flat-rate connection to Internet users. Under these conditions, participants are informed that any access to the game on a free or flat-rate basis (such as a connection by cable, ADSL, etc.) will not give rise to any reimbursement, on the grounds that the subscription to the services of the access provider is contracted by the Internet user for his or her overall use of the Internet, and that the fact that participants connect to the Facebook social network and participate in the game does not incur any additional costs.
The postal costs incurred for the request for reimbursement will be reimbursed on the basis of a stamp at the slow rate in force (less than 20g) on the date of this game.
To obtain reimbursement of their connection fees as well as the postage costs for their reimbursement request, participants must send the organizing company, within one month of the disbursement of these fees (the postmark being taken as proof), a written request, drawn up on plain paper, containing the following elements:
- name, first name and personal postal address accompanied by an official proof of identity and a bank statement
- name of the game and the website on which the game is accessible
- the supporting invoice with the dates, times and duration of the connection clearly underlined
The organizing company will proceed to reimburse the said expenses by bank transfer, within two (2) months following the reception of the participants' request.
ARTICLE 8 - PERSONAL DATA
In accordance with Law No. 78-17 of January 6, 1978, on information technology, files and freedoms, and European Directive No. 95/46 of October 24, 1995, on the protection of individuals with regard to the processing of personal data and on the free movement of such data, the winners' contact information may be processed on paper or by automated processing. In accordance with articles 38 and following of the aforementioned law, the winners have the right to access, rectify and delete data concerning them by sending a written request to the game address.
Persons who exercise the right to delete their data before the end of the operation will be deemed to have waived their participation.
The organizing company and its partner Rouje are the only recipients of the information collected, and this information will not be used for commercial prospecting purposes, nor will it be transmitted to other commercial partners without the prior consent of the participants.
