ARTICLE 1 - ORGANIZER
The www.ohmycream.com website is published and produced by Oh My Cream, a simplified joint stock company with share capital of €22,910, registered with the Paris Trade and Companies Registry under number 751 427 527, whose registered office is located at 47 rue de Babylone, 75007 Paris, France. Oh My Cream's VAT number is FR71751427527. The publication director is Mrs Juliette Lévy. Oh My Cream organizes under the conditions defined below, a free contest without obligation to purchase entitled "Bonsoirs x Oh My Cream Contest" from Friday, October 20, 2023 (9:00 am) to Monday, October 30, 2023 (11:59 pm), as part of the promotion of its products.
ARTICLE 2 - CONDITIONS OF ACCESS TO THE GAME
The game is open to all natural persons of legal age residing in mainland France, excluding members of the organizing company's staff and members of their families in direct line (ascendants, descendants) or collateral line, their spouse, cohabitee or civil union partner.
Failure to comply with the conditions of participation set out in these rules will render participation null and void.
The organizing company reserves the right to carry out any checks it deems necessary, in particular concerning the identity, age and address of each participant, with a view to ensuring compliance with the stipulations of these rules.
ARTICLE 3 - PRIZES
1 winner will be awarded the following prize:
- The Oh My Cream Skincare Plumping treatment to be carried out in the Oh My Cream boutique of your choice.
- A complete Oh My Cream Skincare routine worth €500, including: your double cleansing duo, the Exfoliating Powder, the Gua Sha Visage, the Moisturizing Serum, the Eye Contour Balm, the Plumping Oil, the SOS Mask, the Dry Brush, our Nourishing Scrub and the Plumping Food Supplement.
- A voucher worth €500 to discover Vie de Château, the new collection in precious, comfortable materials by Bonsoirs.
ARTICLE 4 - HOW TO ENTER
To enter, each participant must:
- Log on to the ohmycream.com website;
- Go to the web page: https://www.ohmycream.com/pages/concours-bonsoirs-x-oh-my-cream
- Complete the entry form with all mandatory information, and click on "I'm entering"
No reply sent by any other means (private message, email...) will be accepted. Only one entry per person will be accepted.
ARTICLE 5 - AWARDING OF PRIZES
The organizing company will proceed with a draw among the participants who have completed the form in order to designate one (1) winner.
The name of the winner will be indicated on October 31, 2023, by sending an email to the winner, who will be invited to communicate their contact details (surname, first name and postal address), within seven (7) days, by email to the organizing company. If the winner does not reply within this period, he/she will be deemed to have renounced his/her prize.
The organizer undertakes to send the prizes by ordinary mail, within six (6) weeks of the transmission of the winner's contact details (as evidenced by the postmark).
Prizes that cannot be delivered for reasons beyond the control of the organizing company (incorrect address, no reply from the winner, etc.) will be definitively lost and cannot be reallocated.
The winner may not claim the cash equivalent of the prize won or request its exchange for other goods or services, for any reason whatsoever. The prizes may also not be passed on to third parties.
In the event of force majeure or if circumstances so require, the organizing company reserves the right to replace the prizes won with other prizes of equivalent nature and value, without this giving rise to any compensation or indemnity of any kind.
The organizer may not be held liable in the event of delay or loss and/or damage to the prize during transportation.
ARTICLE 6 - DISPUTES AND LIABILITIES
Participation in the game implies unreserved acceptance of the rules in their entirety. Any inaccurate or untruthful declaration or fraud will result in the participant's disqualification.
No telephone or written request concerning the interpretation or application of these rules, the mechanisms or terms of the game or the winner will be answered.
The game's organizing company reserves the right to pursue by any means any attempt to misuse these rules, particularly in the event of the communication of erroneous information.
The organizing company cannot be held responsible for any incidents that may arise from the use of the prizes awarded.
Oh My Cream will not be held responsible in the event of an Internet network malfunction preventing access to the game or its smooth running.
In all other cases, in the event of a dispute or claim, requests must be sent to Oh My Cream within a maximum of fifteen (15) days after the end of the game (as evidenced by the postmark), by simple letter addressed to "Customer Service". This letter must indicate the precise date of participation in the game, the participant's full contact details and the exact reason for the dispute. No other method of dispute or claim may be taken into account. The decisions of the organizer are final: Oh My Cream is the sole arbiter of all questions relating to the application of the rules.
The game and the interpretation of the present rules are subject to French law.
ARTICLE 7 - REIMBURSEMENT OF FEES
For participants who use an Internet connection that is billed by the duration of the connection, the Internet connection for participation in the game will be reimbursed by simple written request to the organizing company's address, upon presentation of proof and on a flat-rate basis of €0.16 (incl. VAT) per minute.
Given the current state of service offerings and technology, some Internet service providers offer free or flat-rate connections to Internet users. Under these conditions, participants are informed that any access to the game carried out on a free or flat-rate basis (such as in particular connection by cable, ADSL, etc.) will not give rise to any reimbursement, on the grounds that the subscription to the services of the access provider is contracted by the Internet user for his overall use of the Internet and that the fact that participants connect to the Facebook social network and take part in the game does not cause them to incur any additional costs.
Postal charges incurred for the reimbursement request will be reimbursed on the basis of a stamp at the slow rate in force (less than 20g) on the date of this game.
To obtain reimbursement of their connection costs and the cost of postage for their reimbursement request, participants must send the organizing company, within one month of disbursement of these costs (as evidenced by the postmark), a written request, drawn up on plain paper, containing the following information:
- surname, first name and personal postal address, together with official proof of identity and a bank statement
- the name of the game and the website on which the game is accessible
- the supporting invoice with the dates, times and durations of connection clearly underlined
The organizing company will reimburse the said costs by bank transfer within two (2) months of receipt of the participants' request.
ARTICLE 8 - PERSONAL DATA
In accordance with French law no. 78-17 of January 6, 1978 on data processing, data files and individual liberties, and European directive no. 95/46 of October 24, 1995 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, winners' contact details may be processed on paper or by automated means. In accordance with articles 38 et seq. of the aforementioned law, the winners have the right to access, rectify and delete their personal data by sending a written request to the game address.
Persons who exercise their right to delete their personal data before the end of the operation will be deemed to have waived their right to participate.
The organizing company Oh My Cream and its partner Bonsoirs are the sole recipients of the information collected, and it will not be used for commercial prospecting purposes, nor passed on to other commercial partners without the prior consent of the participants.
